Advocaat J.S. Nan - Salduz, of hoe een Turkse jongen strafrechtelijk Europa op zijn kop zet

16-11-2010 Als iets voer voor juristen is, snapt de gemiddelde burger er niets van. Als iets voer voor professoren straf(proces)recht is, zal zelfs de gemiddelde strafjurist zich wellicht wat onzeker voelen. Ik ben de kluts aangaande het recht van een (aangehouden) verdachte op juridische bijstand tijdens een politieverhoor – na de laatste ontwikkelingen – in ieder geval kwijt. In Hemelsnaam: heeft een volwassen, niet-kwetsbare, verdachte nu wel of niet recht op een advocaat bij zijn politieverhoor?
Na Brusco v. France (EHRM 14 oktober 2010) vindt professor Spronken steeds meer van wel (maar dat is niet zo gek, nu zij in haar vrije tijd ook advocaat is), maar professor Borgers vindt op zijn beurt nog steeds van niet. Zo op het eerste gezicht lijkt Spronken de sterkste papieren te hebben. In par. 45 overweegt het Europese Hof voor de Rechten van de Mens: ‘La Cour rappelle également que la personne placée en garde à vue a le droit d’être assistée d’un avocat dès le début de cette mesure ainsi que pendant les interrogatoires’. Het gaat dus om rechtsbijstand tijdens het verhoor. Als de advocaat niet bij het verhoor aanwezig mag zijn, lijkt mij een effectieve rechtsbijstand niet of nauwelijks mogelijk. Tussendoor overleg tussen de verdachte en zijn raadsman komt mij alles behalve praktisch voor. Maar aan de andere kant, waarom bepaalt het EHRM dan niet met zoveel woorden dat de raadsman er (fysiek) bij mag zijn en volstaat hij met een verwijzing naar onder meer Salduz? Daarin staat dat recht ook niet met zoveel woorden voor de volwassen verdachte. Het moet toch weten dat dit de gemoederen al een tijdje bezig houdt?
Uit de eerste serie arresten van de Hoge Raad aangaande deze kwestie (zie onder meer NJ 2009, 349 m.nt. T.M. Schalken), valt op de maken dat de Hoge Raad niet happig is uit de uitspraken van het EHRM het recht op een advocaat bij het verhoor toe te kennen. De Hoge Raad houdt het bij een consultatierecht voorafgaand aan het eerste verhoor. Die zuinige uitleg herhaalde hij in uitspraken van oktober en november van dit jaar (respectievelijk LJN BN2352 en LJN BN7727). In laatstgenoemde uitspraak bepaalde hij ook dat het consultatierecht niet geldt voor de niet-aangehouden verdachte. Van ons hoogste rechtscollege hoeven we het in deze dus niet te hebben.
Of dat erg is vraag ik mij overigens af. Weliswaar heeft recent onderzoek ‘Experiment met advocaat bij eerste politieverhoor’ (WODC & EUR), onder meer uitgewezen dat er minder pressie op verdachten wordt uitgeoefend als er bij het verhoor een raadsman aanwezig was, maar van structurele misstanden zonder diens aanwezigheid lijkt ook weer geen sprake te zijn. En als ik voor mezelf spreek – alsof ik dat niet al deed – wil ik als advocaat ook helemaal niet bij zo’n verhoor aanwezig zijn. Ik zie mezelf daar al de hele ochtend zitten, stilletjes in een hoekje, slurpend aan een bakje automatenkoffie van de politie (en dan heb ik het nog niet eens over de ongetwijfeld schamele vergoeding die daar in toevoegingzaken voor toegekend zal worden). Daarvoor heb ik niet zes-en-een-half jaar op de Universiteit Leiden gezeten!
Wat mij betreft moet een goed functionerend consultatierecht, gecombineerd met audiovisuele registratie, afdoende zijn om een verdachte voor te bereiden op zijn (eerste) verhoor en de verbalisanten tijdens dat verhoor in toom te houden. Mocht naar mening van de verdachte een en ander niet juist of onvolledig zijn gerelateerd (daar helpt de aanwezigheid van een advocaat dan overigens wel weer bij, zo leert het voormelde onderzoek), dan kunnen alle procesdeelnemers dat controleren aan de hand van beeld en geluid. En als de verdachte tijdens een verhoor het allemaal niet meer weet, brengt hij als het goed is de eerste les van zijn (piket)advocaat in de praktijk: spreken is zilver, zwijgen is goud.

Ik ben het niet vaak met een advocaat eens als het om verhoren gaat maar deze keer deel ik de mening van J.N. Nan daar waar het gaat om zijn visie op de aanwezigheid van de advocaat bij het politieverhoor: een goed functionerend consultatierecht en de verhoren audio(visueel) vastleggen.
Daar moet een verdachte toch een heel eind mee kunnen komen in het proces van waarheidsvinding waar het verhoor nu eenmaal onderdeel van uitmaakt. Spreken is dan toch een element dat kan bijdragen aan die waarheidsvinding.

Toch kan ook Nan het niet laten om spreken als zilver te betitelen en zwijgen als goud. Ik vroeg mij vorige week bij het bekijken van oude video-opnamen van het verhoor van Ferdi E. af wat er gebeurd zou zijn als er naast Ferdi voortdurend een advocaat had gezeten die zijn cliënt alleen maar tot stilte maande. Was er dan een bekentenis gekomen en was het lichaam van het slachtoffer dan ooit gevonden?

En als we het dan toch over “valse bekentenissen” hebben die tot een veroordeling leidden, deze zijn bij mijn weten altijd pas afgelegd NA het eerste politieverhoor.

In Engeland is inmiddels onderzoek gedaan het effect van de zwijgende verdachte. Het lijkt erop dat de rechters daar de het zwijgen van de verdachte, bij een verder sterke bewijslast, als een strafverzwarend element gaan zien. Wordt het toch nog lastig om een cliënt goed te adviseren.

Tot slot, misschien is het voor advocaten een oplossing als een HBO-jurist bij het verhoor mag gaan zitten en plaatsvervangend die slechte koffie mag drinken. Ook over de kwaliteit van de koffie ben ik het trouwens met Nan eens.

Salduz heeft naar mijn mening minder het (internationale) strafrecht op zijn kop gezet dan in zijn algemeen wordt verondersteld en het overigens prima betoog van Nan doet vermoeden. Laten we wel wezen, in het overgrote deel van (beschaafd) Europa had de verdachte al het recht om voor en/of bij het verhoor te worden bijgestaan dor een advocaat en was/is dat recht in veel landen ook in wetgeving verankerd. Nederland is als een van de weinige de vreemde eend in de bijt omdat - althans de politiek de advocaat "het verlengstuk van de 'crimineel' zou zijn. Het is dan ook niet verwonderlijk dat het ooit als bolwerk van de bescherming van grondrechten beschouwde Nederland thans uitermate nadelig is beoordeeld waar het neerkomt op de bescherming van de rechten van de burger. Voor de goede verstaander was dan ook allang duidelijk dat voor het EHRM vaststond dat élke verdachte aangehouden of niet minderjarige of niet met het oog op het recht op een 'fair trial' in de zin van lid 1 (en 'fair investigation') en het bepaalde in lid 3 van art. 6 EVRM zondermeer het recht toekwam op rechtsbijstand door een advocaat tijdens het verhoor (Murray vs GB). Het bijzondere aan Salduz is echter de expliciete oplegging van de lasten aan de overheid hier expliciet en nadrukkelijk op te wijzen en deze consultatie ook daadwerkelijk te effectueren door het oproepen van een advocaat (hoewel ook dát Impliciet voortvloeide uit Murray). Voorts is de ijzeren voorwaarde van de 'waiver of rights' van belang welke sedert Dingemans wellicht niet alleen (meer) voor minderjarigen niet te lichtvaardig mag worden aangenomen. Alleen al gelet op Murray vs GB is het oordeel van de hoge Raad dat niet aangehouden verdachten geen recht op het consultatierecht zouden hebben onjuist, onbegrijpelijk en onverdedigbaar. Het EHRM heeft immers, terecht geoordeeld dat de cautie op zichzelf voor verdachten onvoldoende waarborgen biedt tegen zelf-incriminatie. Ook de niet aangehouden verdachte bevindt zich evenwel tussen exact hetzelfde wal en schip als de aangehouden verdachte. Volgens het EHRM vereíst de ‘equality of arms' dat de verdachte het recht op een advocaat krijgt. Niet alleen in Engeland maar ook in Nederland geldt immers dat de 'proceshouding' van een consequent zwijgend of ontkennend verdachte wel degelijk van nadelige invloed is op de strafmaat. En het EHRM heeft daar ook niets ook tegen: "National laws may attach consequences to the attitude of an accused at the initial stages of police interrogation which are decisive for the prospects of the defence in any subsequent criminal proceedings.” Echter: “In such circumstances, Article 6 will normally require that the accused be allowed to benefit from the assistance of a lawyer already at the initial stages of police interrogation(r.o.52 Salduz)." Het EHRM is glashelder :"At the same time, an accused often finds himself in a particularly vulnerable position at that stage of the proceedings, the effect of which is amplified by the fact that legislation on criminal procedure tends to become increasingly complex, notably with respect to the rules governing the gathering and use of evidence. In most cases, this particular vulnerability can only be properly compensated for by the assistance of a lawyer whose task it is, among other things, to help to ensure respect of the right of an accused not to incriminate himself. This right indeed presupposes that the prosecution in a criminal case seek to prove their case against the accused without resort to evidence obtained through methods of coercion or oppression in defiance of the will of the accused (see Jalloh v. Germany [GC], no. 54810/00, § 100, ECHR 2006-..., and Kolu v. Turkey, no. 35811/97, § 51, 2 August 2005). Early access to a lawyer is part of the procedural safeguards to which the Court will have particular regard when examining whether a procedure has extinguished the very essence of the privilege against self-incrimination." Een uitgemaakte zaak dus. Het bijzondere van Salduz is dus niet zo zeer dát de verdachte het recht op een advocaat heeft, maar dat de HR eindelijk (zij het gedeeltelijk) is omgegaan op dit punt. Overigens is niet onbelangrijk dat Knigge bij de beroemde arresten van de HR van 30 juni 2009 heeft overwogen dat er wellicht geen rechtvaardiging bestaat voor het maken van enig verschil tussen aangehouden en niet aangehouden verdachten. Anders dan de Hoge Raad ben ik dat hartgrondig met hem eens en wel om de navolgende gedachte. In het Nalatige Inspecteur arrest bepaalde de HR dat een verdachte reeds moest worden gewezen op de cautie zodra hij werd verhoord, of er wel of geen sprake was van aanhouding was niet relevant. Vanaf het moment dat een burger is verdacht heeft hij het zwijgrecht. Dat brengt met zich mee dat een burger ook het recht heeft om door een advocaat te worden verteld wat de consequenties zijn van het al dan niet gebruik maken van dit recht. Het enige verschil tussen de aangehouden en niet aangehouden verdachte is dat deze laatste in staat is zelf een advocaat in de arm te nemen en de overheid derhalve niet gehouden kan worden in de consultatie te faciliteren, maar uit niets, en in het bijzonder niet uit de bestendige jurisprudentie valt af te leiden dat de niet aangehouden burger evenmin op het consultatierecht gewezen zou moeten worden danwel niet eerst na een 'waiver of rights' rechtsgeldig kan worden verhoord. Met Nan ben ik eens dat we het niet van ons hoogste rechtscollege, dat voornoemde punten angstvallig omzeilt, hoeven te hebben, hetgeen overigens eigenaardig is aangezien de Hoge Raad in 2006 voor het eerst in haar bestaan zelf de noodklok luidde over de teloorgang van het Nederlandse strafrecht (NRC 8 mei 2006). Aldus zou men verwachten dat de Hoge Raad de overheid flink op zijn donder zou geven Eerlijkheidshalve geldt natuurlijk dat het nogal een omslag is die gemaakt moet worden en doet de HR soms wél zijn best. In de Dingemanszaak werd het Hof stevig op zijn vingers getikt omdat de ‘waiver of rights’ aangaande de bijstand door een advocaat te gemakkelijk werd aangenomen. Weliswaar zag dit toe op een andere fase, maar het getuigt wel van de verschuiving van het gewicht naar de verdachte leek die meer dan vroeger tegen zichzelf beschermt moet worden. Dat de HR nog niet zover is dat deze ook niet aangehouden verdachten het consultatierecht toekent en het recht op de advocaat bij het verhoor erkent, betekend uiteraard niet – en dat leidt ik ook niet af uit zijn verhaal – dat strafpleiters de strijd moeten opgeven. Integendeel juist, de advocatuur moet deze volop aangaan. Ook op die punten moét de HR toch eens omgaan. Het enige minpuntje van Nan’s verhaal is mijns inziens de op zich begrijpelijke afkeer van het (onderbetaald) bijwonen van verhoor. Echter, mijns inziens mag onderbetaling hoe vervelend en verwerpelijk ook, geen reden zijn voor een advocaat zijn cliënt niet bij te staan. Het gaat er niet om of de aanwezigheid van de advocaat misstanden voorkomt. Als oud-politieambtenaar (voor ik de toga aantrok) ben ik er ondanks alles wel van overtuigd dat de meeste politieverhoren zonder onrechtmatige dwang verlopen. Het gaat er echter om dat de verdachte zich door de (enkele) aanwezigheid van de advocaat gesterkt kan voelen in de weigering een verklaring af te leggen. Bovendien staan sommige opsporingsambtenaren in de praktijk een actieve rol van de advocaat (oogluikend) toe of vragen daar zelfs om. Het belang van de cliënt moet hoe dan ook voorop (blijven) staan en dat is niet gediend bij aanwezigheid van een HBO-jurist of afwezigheid van de advocaat.
